Analysis

On April 22, 2021, California Assembly Committee on Labor and Employment passed AB257 BY A 5-2 vote along party lines. The bill will now move to the California Committee on Judiciary.

Looking Forward

Many of the California Assembly Committee on Labor and Employment members that passed AB5 remain on the committee and those members voted the same way as they did in 2019. The Committee on Judiciary may have a different view of the legality of the Fast Food Sector Council or the new joint employer presumption but, again, that Committee is unlikely to make any positive changes to the bill. The best hope for any substantive changes to the bill will be prior to a floor vote in the Assembly or in the Senate.
